Power of Attorney in Spain
A Power of Attorney (Poder Notarial) lets you authorise someone you trust to act on your behalf in Spain. It can be especially useful if you live abroad, own property in Spain or cannot attend appointments in person.
When might you need one?
A Power of Attorney can allow your representative to:
Buy or sell property in Spain.
Deal with banks, tax matters and other financial paperwork.
Handle residency applications and administrative procedures, where permitted.
Sign documents or complete legal transactions on your behalf.
The powers granted depend on how the document is drafted.
How to make a Power of Attorney
Decide who to appoint
Choose someone you trust, such as a lawyer or another reliable representative. Make sure the document only grants the powers you want them to have.
Prepare the document
A Spanish notary can prepare a poder notarial based on your needs. Some powers are specific to one transaction, while others cover a broader range of matters.
Sign before a notary
You can usually sign in Spain before a Spanish notary. If you are abroad, you may be able to sign through a Spanish consulate or a notary in your country. Foreign documents may require an apostille or legalisation and a sworn Spanish translation.
Give your representative the necessary document
Your representative may need the original or an authorised copy to carry out the relevant transaction. Check the requirements with the bank, authority or professional involved.
Can you cancel a Power of Attorney?
In many cases, you can revoke a Power of Attorney, provided you have the legal capacity to do so. You should notify your representative and any relevant institutions, and follow the required formalities.
A Power of Attorney gives another person legal authority to act for you. Use a carefully drafted document, grant only the powers needed and seek legal advice if it involves property, substantial funds or complex legal matters.
You can appoint Spain Simplified to Represent you and give them your power of attorney or arrange who you want to be appointed.
